Terms of Service

1. Acceptance of the Terms

By downloading, installing, or using the OnTry mobile application (the "App") you enter into a binding agreement with OnTry, located in Germany, ("we", "us", "our"). If you do not agree, do not use the App.

2. Eligibility

You must be (a) at least 16 years old (or the age of digital consent in your country) and (b) legally capable of forming a contract. If you are under 18 you confirm you have parental or guardian consent.

3. Account Registration

You may sign up with an email + password or via Apple or Google Sign-In.

During onboarding we ask for: name, email, gender, birthday, and country.

You agree to provide accurate information and keep it up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Plans & Credits

¹Unused credits expire at the end of each billing cycle and do not roll over or convert to cash.

A "try-on" (applying a product to an uploaded image) consumes one credit.

5. Payments & Billing

Payments are processed by Apple App Store or Google Play. Your subscription and any refunds are governed by their rules in addition to ours. Prices include VAT where applicable. We may change prices with at least 30 days' notice; you may then cancel before the new price takes effect.

EU 14-Day Right of Withdrawal. If you are an EU consumer, you may withdraw from a Premium subscription within 14 days of purchase. Credits already consumed before withdrawal are deducted pro-rata.

6. License & App Use

We grant you a personal, non-exclusive, revocable, non-transferable license to use the App solely for private, non-commercial purposes and in accordance with these Terms.

7. User Content

"User Content" includes any images you upload and any results generated. You retain ownership of your images. You grant us a worldwide, non-exclusive license to host, process, and display User Content solely to provide the service. We do not use your images for advertising without your explicit consent.

8. Prohibited Conduct

You agree not to:

• upload unlawful, offensive, or infringing content;
• decompile, reverse engineer, or otherwise misuse the App;
• sell or transfer credits or results to others;
• attempt to access another user's account.

9. Intellectual Property

All intellectual-property rights in the App (code, design, trademarks, etc.) remain with OnTry or its licensors. Except as expressly set out, nothing gives you any right to our IP.

10. Privacy

Our collection and processing of personal data are described in the Privacy Policy. By using the App, you acknowledge and agree to those practices.

11. Third-Party Content & Links

The App displays virtual versions of third-party products. Product data (including images, descriptions, and pricing) is provided by external retailers. We are not responsible for the accuracy or availability of third-party information, nor for any purchases you make from those retailers.

12. Termination

You may delete your account at any time via the App or by emailing [email protected]. We may suspend or terminate your access immediately if you materially breach these Terms. Upon termination, unused credits are forfeited and are not refunded.

13. Disclaimer of Warranties

The App and all results are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that virtual try-on results will perfectly match real-world product appearance.

14. Limitation of Liability

To the fullest extent allowed by applicable law, our total liability to you for any claim arising out of or relating to the App shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim or (b) €50. We are not liable for indirect, incidental, consequential, or punitive damages.

15. Indemnification

You agree to indemnify and hold harmless OnTry, its directors, employees, and partners from any claim or demand arising out of your misuse of the App or your breach of these Terms.

16. Governing Law & Dispute Resolution

Unless otherwise required by a mandatory law of your country of residence, these Terms are governed by the laws of Germany without regard to conflict-of-law rules. The courts of Germany shall have exclusive jurisdiction, or, if you are an EU consumer, any competent court in your place of residence. Consumers in the EU may also submit disputes to the EU Online Dispute Resolution platform: https://ec.europa.eu/odr.

17. Changes to These Terms

We may amend these Terms at any time. We will notify you in-app or by email at least 14 days before changes take effect. Your continued use after the effective date constitutes acceptance.

If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver.
